Resources for Facilitating Implementation of Amended TSCA

As you may be aware, the EPA has recently issued two key risk-related documents for implementing TSCA, as amended by the Frank Lautenberg Chemical Safety for the 21st Century Act.  These are:

  1. Procedures for Chemical Risk Evaluation Under the Amended Toxic Substances Control Act, and
  1. Guidance to Assist Interested Persons in Developing and Submitting Draft Risk Evaluations under the Toxic Substances Control Act

In addition, EPA has been completing risk determinations for pre-manufacture notices (PMNs) under the amendments, in many cases resulting in Section 5 use restrictions and testing orders.

EPA’s guidance and procedures include concepts such as fit-for-purpose evaluations, life-cycle exposures, susceptible populations, weight of evidence, and best available science. EPA also encourages, where appropriate, the use of alternative testing approaches.
